Thus the things, this improper use of previous expositions in the trial, causes serious violations of fundamental guarantees on procedural subjects, which entail, are some cases, lead to procedural nullities, and in others, the change of the primary decision or Secondary, either by the courts or the Supreme Court respectively.     Abstract

    El presente trabajo de investigación trata sobre la incidencia y el valor probatorio que revisten las versiones previas rendidas por los testigos antes del juicio dentro del proceso penal, las cuales mediante actos de investigación son recolectadas en la etapa de indagación e investigación por los grupos investigativos para orientación de las partes con el fin de desarrollar su teoría del caso. En ese orden, estas exposiciones previas, llegan a formar parte del acervo probatorio que los sujetos procesales utilizan en la audiencia de juicio oral, pero que, desde ya, hay que decirse, estas no se constituyen como medios de conocimientos autónomos, sino que su única incidencia probatoria en el proceso penal será como prueba de referencia. Sin embargo, se observa, que las versiones previas, en ocasiones son usadas de manera equivoca dentro del desarrollo del juicio, incurriéndose en errores de procedimiento, por ejemplo: permitir la introducción y valoración de una versión previa como elemento probatorio autónomo, o no introducir ni valorar una versión previa con calidad de prueba de referencia siendo ésta esencial, o llegar al extremo de emitirse un fallo basado únicamente en pruebas de referencia. Estos errores de apreciación y valoración se presentan, casi siempre, por el desconocimiento que se tiene de la producción de la prueba en el juicio oral, es decir, se desconoce del verdadero valor probatorio que estas revisten. Así las cosas, ese uso inadecuado de las exposiciones previas en el juicio, ocasiona graves vulneraciones de garantías fundamentales sobre los sujetos procesales, lo cuales que conllevan, en algunos casos, a nulidades procesales, y en otros, al cambio de la decisión primaria o secundaria, ya sea por parte de los tribunales o de la Corte Suprema de Justicia respectivamente. Por lo anterior, es importante aclarar, en qué circunstancias las versiones previas pueden tener incidencia probatoria en el proceso penal.
