    Abstract

    El presente trabajo de investigación, consiste en desarrollar un análisis respecto del impacto causado con la sentencia de nulidad del Consejo de Estado, sobre el artículo 14 del Decreto 4433 de 2004. Al ser retirado este artículo del ordenamiento jurídico, evidentemente se quebranta el principio de Confianza Legítima, el cual debe ser un postulado de especial protección para el Estado, teniendo en cuenta la buena fe que se presumen de los administrados y que general eventuales derechos personales a los administrados. en el caso objeto de esta investigación, se logra evidenciar que de manera intempestiva el grupo de oficiales y suboficiales que consolidaron su derecho a la asignación de retiro, y tenían un tiempo de servicios de entre 24 y 29 años, adquirieron legítimamente el derecho de que se les reconociera un 2% adicional a su asignación básica por cada año de servicios, adicional a los 24 años sin que este porcentaje superara el 95%, y al decretarse la nulidad y retirarse esta norma del espectro jurídico se afectaron sus derechos y por lo tanto se quebrantó el principio de confianza legítima que les asistía y debía ser garantizado por la administración.
