dc.description.abstract	Esta investigación consiste en ponderar el principio internacional de la soberanía de un Estado cuando realiza actos como expulsar a un migrante de su país, frente a un derecho humano como la unidad familiar, cuando un migrante al ser expulsado de un país, es separado de su familia, en el contexto de la migración venezolana en Perú. Por lo anterior, surge el interrogante de saber, qué primacía tiene el derecho a la unidad familiar dentro del marco de protección de los migrantes irregulares con antecedentes penales provenientes de Venezuela en Perú, específicamente en la época que reza entre el año 2014 a 2020 cuando se contrapone la seguridad estatal. Esta investigación contribuirá con crear parámetros acordes al derecho internacional en las políticas migratorias de un Estado. El criterio metodológico que se empleó fue el método cualitativo y cuantitativo, a través de la recolección de información con estadísticas, informes, pronunciamientos de las altas cortes internacionales y nacionales y criterios conceptuales relativos a la migración; esto permitió i) enmarcar conceptos importantes sobre los derechos de los migrantes en busca de asilo y la actuación del Estado a través de su actuar, ii) estudiar el sistema jurídico de Perú frente a los migrantes irregulares con antecedentes penales, iii) analizar de manera amplia los principios internacionales como la no discriminación pero también las causas del aumento de criminalidad en Perú y iv) a través del control de convencionalidad ponderar un principio frente a un derecho. Se realizaron conclusiones de la ponderación de un principio frente a un derecho en la situación de expulsión de un migrante venezolano de Perú, contemplando diferentes variables.	spa
dc.description.abstract	This research consists in weighing the international principle of the sovereignty of a State when it performs acts such as expelling a migrant from his or her country, against a human right such as the family unit, when a migrant upon expulsion from a country is separated from his or her family, in the context of Venezuelan migration in Peru. Therefore, the question arises as to what primacy the right to family unity has within the framework of protection of irregular migrants with criminal records from Venezuela in Peru, specifically in the time between 2014 and 2020 when state security is at odds. This research will contribute to the creation of parameters in accordance with international law in the migration policies of a State. The methodological approach used was qualitative and quantitative, through the collection of information with statistics, reports, pronouncements of high international and national courts and conceptual criteria relating to migration; this made it possible i) to frame important concepts on the rights of migrants seeking asylum and the action of the State through its actions, ii) to study the legal system of Peru in the face of irregular migrants with criminal records, iii) to analyze in a broad way the international principles such as the non-discrimination but also the causes of the increase of criminality in Peru and iv) through the control of conventionality to weigh a principle against a right. Conclusions were made on the weighting of a principle against a right in the situation of expulsion of a Venezuelan migrant from Peru, considering different variables.	eng
