El estado y su responsabilidad en la violación de los derechos a la vida y la justicia propia del Pueblo Nasa dentro del Consejo Regional Indígena del Cauca durante los años 2019 - 2021

Abstract

In this work, it is intended to analyze the national doctrine and jurisprudence in relation to the indigenous communities of northern Cauca, focusing specifically on the Nasa People. The objective is to explore the State's response to the violation of the rights to life and territory during the years 2019-2021. In addition, the historical evolution of the organizational process of the CRIC and the Nasa People is examined to investigate the actions of the State in the protection of the constitutional rights of the indigenous communities of said region. Due to the above, the following research question arises: What is the responsibility of the State in the violation of the rights to life and territory of the Nasa People who inhabit the North of Cauca during the years 2019-2021?

This analysis is carried out considering the historical context and the main difficulties that affect the rights to life and self-justice in the territories where these communities reside. In addition, the theories of Neoconstitutionalism and legal pluralism are addressed to determine their relevance in the recognition and protection of the rights of indigenous peoples. This field of research is little explored, but it is crucial to understand the geopolitical and social contexts that influence the legal field.
