Therefore, it is proposed to identify the legal and economic effects of the probative deficiency derived from the clinical history on the Colombian State, given its significant probative value within the framework of the responsibility for a medical act, in order to arrive at the conclusions of the present study. makes a broad conceptual and theoretical reference, delving into the set by doctrine, jurisprudence and comparative law. Finding as research conclusions, a great relevance of the clinical history as a documentary evidence and as a significant indication for health medical cases, as well as the identification of ten rules and three subgrades decanted from the hermeneutics of the Third Section of the State Council for the period under study. On the other hand, judicial congestion is outlined, as well as the slowing down of judicial decisions as the main legal effects, and the high fiscal burden as the main economic effect. Finally, the invitation to carry out a similar analysis in the future to validate if the implementation of the electronic medical record allowed to avoid the difficulties in factual accreditation that derive today from the conventional clinical history - of manual completion - leading to a decrease in the sentences against the State in terms of Medical Responsibility.     Abstract

    Sin lugar a dudas, la Responsabilidad Médica ocupa un espacio importante dentro de la Responsabilidad patrimonial del Estado, en igual sentido, esta temática ha sido abordada desde la doctrina y la academia en múltiples oportunidades, no obstante, el estado del arte permitió evidenciar que poco se ha indagado en relación a la relevancia de la historia clínica como medio probatorio y las dificultades de acreditación fáctica que de allí se podrían derivar, convirtiéndose éste en el eje de investigación para el presente estudio. Así pues, se propende identificar qué efectos jurídicos y económicos tiene sobre el Estado Colombiano la deficiencia probatoria derivada de la historia clínica, habida cuenta su significativo valor probatorio en el marco de la responsabilidad por acto médico. Para arribar a las conclusiones del presente estudio, se realiza una amplia referencia conceptual y teórica, ahondando en lo fijado por la doctrina, la jurisprudencia y el derecho comparado. Encontrándose como conclusiones de investigación, una gran relevancia de la historia clínica como medio probatorio documental y como indicio significativo para casos medico sanitarios, al igual que la identificación de diez reglas y tres subreglas decantadas desde la hermenéutica de la Sección Tercera del Consejo de Estado para el periodo en estudio. De otro lado, se esbozan la congestión judicial así como la ralentización de las decisiones judiciales como principales efectos jurídicos, y la alta carga fiscal como principal efecto económico. Finalmente, se deja abierta la invitación a realizar un análisis similar en un futuro, para validar si la implementación de la historia clínica electrónica permitió soslayar las dificultades en acreditación fáctica que se derivan hoy de la historia clínica convencional – de diligenciamiento manual- conllevando a una disminución en las condenas contra el Estado en términos de Responsabilidad Médica.
