It also brings with it some principles that seek to guarantee the participation of any citizen in front of the state, but it is necessary to highlight and clarify that not all processes comply with these general principles, where it generates great concern due to the fact that resources are being handled state economic; It is clear that there are entities that are legally authorized to adopt internal regulations, but in this investigation they will not be addressed. It has been possible to observe with great care entities that require the acquisition of goods and services for national defense and security, such as the National Police, National Army, National Navy; that do not take into consideration the principles contained for the State Contracting, which organize, regulate, give a transparency to each of the processes, being as important as the rules of participation in a bidding process.     Abstract

    En Colombia, la normatividad para la contratación estatal siempre ha buscado el mejoramiento de la participación y adjudicación de los contratos estatales, satisfaciendo el interés público y social; teniendo dos fuertes Leyes que la regulan la contratación las cuales son la Ley 80 de 1993 y la Ley 1150 de 2007; conteniendo reglas que se deben respetar todo con el fin de lograr un proceso satisfactorio para el cumplimiento de los fines estatales, la continua y eficiente prestación de los servicios públicos y la efectividad de los derechos e intereses de los administrados. Así mismo trae consigo unos principios que buscan garantizar la participación de cualquier ciudadano frente al estado, pero es necesario resaltar y hacer la aclaración que no en todos los procesos se cumplen con estos principios generales, donde genera gran preocupación debido a que se está manejando recursos económicos del estado; es claro que hay entidades que están facultadas legalmente para adoptar reglamentos internos, pero en esta investigación no se abordaran. Se ha podido observar con gran detenimiento entidades que requieren la adquisición de bienes y servicios destinados a la defensa y seguridad nacional, como lo son la Policía Nacional, Ejército Nacional, Armada Nacional; que no tienen en consideración los principios contenidos para la Contratación Estatal, los cuales organizan, regulan, dan una transparencia a cada uno de los procesos, siendo tan importantes como las reglas de participación en un proceso de licitación.
