    Abstract

    La hoja de coca representa para los pueblos indígenas colombianos parte fundamentan dentro de su pervivencia como comunidad y ente colectivo, a su vez, esta planta es insumo para la producción de estupefacientes, lo que ha generado la necesidad del Estado de adelantar acciones que permitan su control, ocasionando para el Estado la necesidad de encontrar mecanismo que permitan por una parte la protección de las comunidades a su pervivencia etnológica y por otra proteger a la comunidad en general en torno a su salud pública y seguridad estatal, es en este escenario donde el proceso de consulta previa como mecanismo de participación se consolida como el instrumento mediador para que el Estado pueda dar protección a estos derechos, no obstante el desarrollo de este instrumento en torno a medidas administrativas que vinculan el control a actividades ilegales es muy débil, generando la necesidad de identificar si los mecanismos jurídicos existentes en materia de consulta previa con comunidades indígenas sobre la erradicación de cultivos ilícitos son o no suficientes.
