The National Agency for Legal Defense of the State, has stated that within its powers is to formulate public policies in matters of prevention of unlawful public conduct, unlawful damage and the extension of its effects (Decree 4085 of 2011, Article 2), and in recent years has expressed concern about the numerous litigation facing the State in the matter of unjust deprivation of liberty, manifested the need to acquire theoretical bases and empirical evidence to indicate what is the thinking of the high courts in this matter and what have been the assumptions that have allowed the current jurisprudence to draw the dominant opinion on this issue. In addition, it is evident that every day the causes of the patrimonial responsibility of the State have been extended, which can have great consequences in the economic sphere of the State and impede the development of the country.     Abstract

    Se evidencia que cada día va en aumento la cifra de demandas por el medio de control de reparación directa, impetradas por el personal que ha sido absuelto en un proceso penal y consideran que el Estado tiene el deber de indemnizarlos por el tiempo que duraron privados de la libertad, aun en los casos de la detención preventiva, más conocida como una medida de aseguramiento para garantizar la comparecencia del sujeto al proceso penal. La Agencia Nacional de Defensa Jurídica del Estado, ha manifestado que dentro de sus facultades se encuentra formular políticas públicas en materia de prevención de las conductas públicas antijurídicas, del daño antijurídico y la extensión de sus efectos (decreto 4085 de 2011, artículo 2), y en los últimos años ha manifestado su preocupación respecto a los numerosos litigios que afronta el Estado en materia de privación injusta de la libertad, manifestado la necesidad de adquirir bases teóricas y evidencia empíricas que indiquen cuál es el pensamiento de las altas cortes en esta materia y cuáles han sido los supuestos que le han permitido a la jurisprudencia actual trazar la opinión dominante en esta temática. Además, se evidencia que cada día se ha ido ampliando las causales de la responsabilidad patrimonial del Estado lo que puede traer grandes consecuencias en materia económica del Estado e impedir el desarrollo del país. Se efectúa un análisis desde el punto de vista sustancial, de la responsabilidad del Estado por la actividad judicial en Colombia, tomando como eje principal la Responsabilidad del Estado por privación injusta de la libertad, como aquella consecuencia de los daños producidos con la prisión provisional, determinando el fundamento de la noción de daño antijurídico y apoyándonos en las distintas interpretaciones de las altas cortes respecto al tema
