| dc.description | La interpretación unilateral del contrato estatal, como clausula exorbitante es un mecanismo de protección de los intereses de la administración, al vincularlo al cumplimiento de los fines del estado, sin embargo existen vacíos tanto normativos como jurisprudenciales, en la aplicación de este, debido a que en la legislación solo un artículo de la ley 80 de 1993 regula la materia, los limites no son claros debido que recurre a criterios del Código Civil y el Código de Comercio, es entonces cuando se configura el principio del equilibrio económico del contrato, como garantía del contratista para convertirse en un mecanismo de protección frente a un criterio excesivo de interpretación unilateral que vulnere los principios legales de protección del contratista. | spa |
| dc.description.abstract | The unilateral interpretation of the state contract, since exorbitant clause is a protection mechanism of the interests of the administration, on having linked it to the fulfillment of the ends of the condition, nevertheless emptinesses exist both normative and jurisprudential, in the application of this one, due to the fact that in the legislation only an article of the law 80 of 1993 regulates the matter, the limits are not clear due to that it resorts to criteria of the Civil Code and the Code of Trade, it is at the time when there is formed the beginning of the economic balance of the contract, as guarantee of the contractor to turn into a protection mechanism opposite to an excessive criterion of unilateral interpretation that damages the legal beginning of protection of the contractor. | spa |
