dc.descriptionLa ecuación contractual y el consecuente equilibrio económico del contrato ha sido un tema muy debatido en la doctrina y jurisprudencia colombiana, ya que a causa de esta, se han presentado muchas interpretaciones que han llegado al litigio entre la entidad contratante y el contratista, en la mayoría de las veces el contratista ha utilizado este principio como una oportunidad de negocio, porque el estado con esta norma es garantista de las utilidades del contratista, a pesar que se ha hecho un esfuerzo enorme para contrarrestar esta situación por medio de políticas emitidas por el CONPES, artículos que fueron agregados en la ley 1150 de 2007 y los diferentes pronunciamientos que ha hecho el consejo de estado sobre el tema, las entidades estatales continúan siendo vulnerables ante los contratistas cuando se presentan situaciones imprevistas durante la ejecución del contrato, aprovechando este principio para no mitigar los riesgos que se pueden presentar a causa de saber que siempre el estado será garante de sus utilidades.spa
dc.description.abstractThe contractual equation and the consequent economic equilibrium of the contract has been one of the much debated subject in the Colombian doctrine and jurisprudence, because of this, many interpretations have been presented that have reached the litigation between the contracting entity and the contractor, Most of the times the contractor has used this principle as a business opportunity, because the state with this, guarantee the contractor's profits, although a huge effort has been made to counteract this situation through policies issued by the CONPES, articles that were added in Law 1150 of 2007 and the different pronouncements made by the state council on the subject, state entities continue to be vulnerable to contractors when unexpected situations arise during the execution of the contract, taking advantage of this principle so as not to mitigate the risks that may arise because of knowing that the state will be guarantor of its utilities.spa
