    Abstract

    Las artimañas y/o la inasistencia del demandado, tendiente a evitar que lo hagan parte de un proceso de filiación, o una vez vinculado al proceso sus excusas dilatorias del mismo a comparecer con el fin de practicarse la prueba de ADN, dentro de los procesos de investigación de Paternidad, no deben convertirse en un obstáculo para lograr la materialización el derecho fundamental del niño a conocer sus orígenes, puesto que se debe hacer uso de las herramientas que la ley contempla y de otras posibles alternativas para lograr la vinculación yo notificación del proceso iniciado en su contra y una vez lo anterior y conminar al presunto padre a que acuda al laboratorio y, una vez agotados dichos mecanismos, deberá proferirse una decisión de fondo que resuelva las pretensiones del demandante niño, niña y adolecente que es representado legalmente por quien tiene su custodia y cuidado personal..
