Through experiences shared by other countries, through the implementation of competent international bodies in national jurisdictions such as WIPO and the suggestion of adoption of its recommendation, which could also be implemented in Colombian legislation to Face and cancel this phenomenon.     Abstract

    Este trabajo tiene el propósito de exponer el tema de la Biopiratería, conocida como una práctica, que se decreta en la apropiación indebida de la biodiversidad y los conocimientos tradicionales y que conlleva al empobrecimiento: biológico, intelectual, cultural y económico de los países megadiversos. El objetivo fundamental de este escrito, es demostrar la importancia de la protección de los Conocimientos Tradicionales y el Patrimonio Inmaterial de la Nación, identificando el papel que juega la legislación nacional e internacional en materia de comercio, propiedad intelectual, diversidad natural y las practica tradicionales de las comunidades indígenas y su control, a través de experiencias que han compartido otros países, mediante la implementación de órganos internacionales competentes en las jurisdicciones nacionales, como la Organización Mundial de Propiedad Intelectual (OMPI) y la sugerencia de la adopción de su recomendación, que también podría ser implementada en la legislación colombiana para enfrentar y anular este fenómeno.
