Los fallos de tutela y su alcance jurisprudencial en materia de salud

Resumen
El presente trabajo desarrolla diferentes temáticos respectos de la evolución de la acción de tutela en Colombia a partir de su promulgación en 1991, entendida como un mecanismo a favor del ciudadano para la protección de derechos fundamentales consagrados en la misma. Resaltando su incidencia en materia de salud, preceptuando su debida protección bajo las premisas de nuevas legislaciones, normatividad reglamentada y precedente judicial. Se ha evidenciado multitudinarias personas solicitando el amparo al derecho a la salud mediante acción de tutela, por lo cual en la actualidad nos enfrentamos a una mal llamada “tutelitis”, como si la acción de tutela consagrada en nuestra carta magna hubiese convertido la tutela en un mecanismo subsidiario acceso al servicio de salud, ya que los jueces de la república están llamados a garantizar los mismos, sin desconocer que en todos los casos se busca la supremacía constitucional a favor de tales derechos. Aclarado lo anterior se evidencio casos en los cuales se han emitido fallos de tutela, ordenando un tratamiento integral desconociendo ciertos conceptos médicos con respecto a la dosificación e insumos requeridos para cierto tipo de patologías.
Abstract
The present work develops different thematic aspects of the evolution of the guardianship
action in Colombia from its promulgation in 1991, understood as a mechanism in favor of the citizen for the protection of the fundamental rights enshrined in the same. Highlighting its impact on health, with due regard to its due protection under the premises of new legislation, regulated regulations and judicial precedent. It has been evident that there are many people requesting protection of the right to health through guardianship, so that today we face a misnamed "tutelitis", as if the action of guardianship enshrined in our charter had converted the guardianship into a subsidiary mechanism access to the health service, since the judges of the republic are called to guarantee them, without ignoring that in all cases seeks constitutional supremacy in favor of such rights. Clarifying the above, there were cases in which they have been issued failures of guardianship, ordering a comprehensive treatment without knowing certain medical concepts regarding the dosage and inputs required for certain types of pathologies.
