Para esto, se hará un análisis a los antecedentes científicos de las técnicas de reproducción humana asistida, así como a la revisión a las diferentes posturas jurídicas desde el derecho comparado y los tribunales internacionales, en el entendido que es importante tener una definición clara en cuanto a la relación entre la maternidad subrogada y el concepto de filiación y sus diferentes variables, se revisaran las posturas de las Altas Cortes colombianas con relevancia temática, teniendo como base la Sentencia T-968 de 2009 de la Corte Constitucional que brindo una definición sobre la maternidad subrogada y algunos proyectos de Ley impulsados por el legislativo.In the present article will review the issue of the surrogate motherhood in Colombia, since on the subject was evident a legal vacuum, because it does not have a specific regulation, thereby creating legal uncertainty in the nature, implementation, and effectiveness of this legal business.
