Las características especiales de adoptar este modelo replantean el marco de garantías frente al tipo de sujetos que confluyen ante la administración de justicia y, frente a los cuales, se espera que, con su contribución al proceso permitan el esclarecimiento de situaciones que marcaron hitos de violencia sistemática registrados públicamente en la memoria histórica del país. Entre las violencias identificadas, sobresale la afectación a grupos históricamente vulnerables y discriminados. Dentro de los insumos para asegurar una correcta aplicación de las sanciones en la ecuación entre víctimas y victimarios, el Estado debe propender por brindar especial atención a estos grupos que, la institucionalidad y la política judicial, han ido distinguiendo de acuerdo con sus propias necesidades de reconocimiento y reparación en términos de no revictimización. El reconocimiento de los grupos de población diversa LGBTIQ+ (personas con orientaciones sexuales, identidades y expresiones de genero diversas) es fundamental para construir modelos de justicia más inclusivos. Esta tarea, aún pendiente para el legislador, debe entenderse como una respuesta resiliente y de larga data para reducir las asimetrías que enfrentan las víctimas debido a su diversidad sexual. Esto implica garantizar el acceso constitucional a la administración de justicia y promover una justicia material, basada en fallos que incorporen una perspectiva con enfoque diferencial y diverso. A partir de la visión y el sentido del fallo que recoja los elementos esenciales de la perspectiva con enfoque diferencial diverso. De acuerdo con lo anterior, el desarrollo de este trabajo se centra en indagar si la Ley de Justicia y Paz como primera respuesta al sometimiento de grupos armados y criminales en Colombia, tuvo limitaciones en su diseño respecto a la identificación y reconocimiento de grupos de especial protección constitucional, como es la población diversa LGBTIQ+ y, si en la actualidad, la evolución en el tratamiento de este grupo históricamente vulnerado a partir de la adopción de nuevos elementos jurídicos en el bloque de constitucionalidad al ordenamiento jurídico interno, han determinado parámetros a implementar en el ejercicio de la función judicial en aras de salvaguardar una aplicación de la Ley de Justicia y Paz con enfoque diferencial en las actuaciones de los servidores judiciales.The implementation of a transitional justice model represents the sum of the efforts of the Colombian Social State of Law to respond to the historical-political demands of a society with the singularity of being preceded by armed conflict scenarios. The special characteristics of adopting this model redefine the framework of guarantees for the type of subjects who come before the administration of justice and whose contribution to the process is expected to shed light on situations that marked milestones of systematic violence publicly recorded in the country's historical memory. Among the violence identified, the most important is the affectation of historically vulnerable and discriminated groups. Among the inputs to ensure a correct application of sanctions in the equation between victims and perpetrators, the State must strive to provide special attention to these groups that the institutions and judicial policy have been distinguishing according to their own needs for recognition and reparation in terms of non-revictimization. The recognition of LGBTIQ+ diverse population groups (people with diverse sexual orientations, identities and gender expressions) in the construction of this and other models of justice, constitutes an unfinished work for the legislator - and for the other powers of the State in a complementary manner - as a resilient response of long standing to reduce the existing asymmetries of the victims affected by their sexual diversity perspective and the violence exercised on their humanity with the constitutional scope of access to the administration of justice and to a material justice, based on the vision and meaning of the ruling that includes the structural elements of the perspective with a diverse differential approach.
