dc.description	Esta investigación se encuentra encaminada a determinar el alcance del concepto de inimputabilidad en el ordenamiento penal colombiano contemplado en su artículo 33, haciendo un análisis de dicha noción guiada específicamente al calificativo de inmadurez psicológica y trastorno mental ,en relación con la comisión del delito de actos sexuales con menor de catorce años, los temas abordados se presentan de manera práctica en la sentencia la cual deja entrever la limitación con la que cuenta el juez al determinar únicamente la condición del sujeto activo en la comisión del delito, dejando de hacer seguimiento hasta el fin último de la medida de seguridad que este mismo ha impuesto; para ello se empleó el método cualitativo que nos permite tener en cuenta la herramienta probatoria más adecuada en el campo penal en el caso mencionado, evidenciando la problemática propuesta frente a nuestro sistema jurídico, enmarcando así la falta del estado al no proporcionar cabalmente una posición garantista para el sujeto activo, puesto que esta, no se despliega al punto de hallar una mejoría mental, si no que remite la responsabilidad a las entidades prestadoras de salud del tratamiento correspondiente, dejando en situación de vulnerabilidad a la víctima y al sujeto activo, ya que al no tener pleno seguimiento de la evolución en su tratamiento, se abre paso a una posible suspensión, sustitución o cesación de la medida, la cual puede generar un inminente riesgo para la sociedad en general al momento de inmiscuirse con un sujeto que no se encuentra en condición para asumir un comportamiento apto.	spa
dc.description.abstract	This investigation is aimed at determining the scope of the concept of unenforceability in the Colombian criminal law contemplated in article 33, making an analysis of this notion guided specifically to the qualifier of psychological immaturity and mental disorder, in relation to the commission of the crime of acts With less than fourteen years of age, the issues addressed are presented in a practical manner in the sentence which allows us to see the limitation with which the judge has to determine only the condition of the active subject in the commission of the offense, not following up until the ultimate goal of the security measure that the same has imposed; For this, the qualitative method that allows us to take into account the most appropriate evidence tool in the criminal field in the aforementioned case was used, evidencing the proposed problem in front of our legal system, thus framing the lack of the state by not fully providing a guarantee position for the active subject, since it is not deployed to the point of finding a mental improvement, but it remits the responsibility to the health care entities for the corresponding treatment, leaving the victim and the active subject in a vulnerable situation. that by not having full monitoring of the evolution in their treatment, it opens the way to a possible suspension, substitution or cessation of the measure, which can generate an imminent risk for society in general at the moment of interfering with a subject that is not is in condition to assume a suitable.	spa
