| dc.description | Judicial self-restraint, also called self-restriction by the Colombian Constitutional Court, has been defined by the Court as a principle, a constitutionally important interpretative tool for the exercise of the jurisdictional power of the State, which seeks to counteract the subjectivism of judges and which is opposed to the figure of judicial activism. This research was based on the hypothesis that the Constitutional Court prefers activist positions over self-restraint positions when deciding on the matters it hears. The objective of this paper is to analyze the Colombian Constitutional Court's duty of self-restraint in the exercise of its acts of control. Through a review of the existing literature on the concept of judicial self-restraint, together with a review of the constitutional rulings in which the Court has referred to the concept of self-restraint, self-restraint or deference and particularly to the judgments issued in the framework of the regulation and implementation of the Final Peace Agreement between the National Government of Colombia and the FARC - EP, it was found that there is no agreement within the Court as to the scope of the concept of self-restraint and that, although it has been used by the Court, in most of the decisions examined, the Court is not self-restrained. | en |
| dc.description | La autocontención judicial, denominada también autorrestricción por la Corte Constitucional colombiana, ha sido definida por esa Corporación como un principio, una herramienta interpretativa constitucionalmente importante para el ejercicio de la facultad jurisdiccional del Estado, que busca contrarrestar el subjetivismo de los jueces y que se contrapone a la figura del activismo judicial. Esta investigación partió de la hipótesis de que la Corte Constitucional a la hora de decidir sobre los asuntos que conoce prefiere las posiciones activistas sobre las posiciones de autocontención. El objetivo de este escrito es analizar el deber de la Corte Constitucional colombiana de autocontenerse en el ejercicio de sus actos de control. A través de una revisión de la literatura existente sobre el concepto de autocontención judicial, sumado a la revisión de las sentencias de constitucionalidad en las que la Corte se ha referido al concepto de autocontención, autorrestricción o deferencia y particularmente a las sentencias proferidas en el marco de la regulación e implementación del Acuerdo Final de Paz entre el Gobierno Nacional de Colombia y las FARC – EP se encontró que no hay acuerdo al interior de la Corte en cuanto al alcance del concepto de autocontención y que, aunque se ha usado por el Tribunal, en la mayoría de las decisiones examinadas, la Corte no se autocontiene. | es |
