Responsabilidad estatal en el reclutamiento ilícito de menores vinculados al conflicto armado interno periodo 2016-2020

Abstract

The recruitment of men over 18 years of age is a State activity with which many civilians do not agree, even when it comes to forming the National Military Forces, but disagreement and rejection increase when it acquires quality. of illegal activity at the time that minors are accessed to integrate them into groups outside the law, the illegality of this fact is great that the amount of human rights violated to children and adolescents ends up being innumerable, because the reality living in war deprives them even of their childhood. State responsibility is analyzed when crimes against children and adolescents were committed because the State did not fulfill its function as the first guarantor of constitutional rights and human rights that are part of the duties of the public administration. Determining what has been the response by the public administration in restoring the rights of the victims of the armed conflict is not only in the interest of those who study the law, but of all Colombians, as it guides the reader as to how the State act when responsible.
