dc.description	En el presente artículo se revisará el tema de la maternidad subrogada en Colombia, ya que sobre el mismo se evidencia un vacío jurídico, puesto que no cuenta con una regulación específica, generando con ello inseguridad jurídica en cuanto a la ejecución y eficacia de este negocio jurídico regulado en otros ordenamientos jurídicos. Para esto, se hará un análisis a los antecedentes científicos de las técnicas de reproducción humana asistida, así como a la revisión a las diferentes posturas jurídicas desde el derecho comparado y los tribunales internacionales, en el entendido que es importante tener una definición clara en cuanto a la relación entre la maternidad subrogada y el concepto de filiación y sus diferentes variables, se revisaran las posturas de las Altas Cortes colombianas con relevancia temática, teniendo como base la Sentencia T-968 de 2009 de la Corte Constitucional que brindo una definición sobre la maternidad subrogada y algunos proyectos de Ley impulsados por el legislativo.	spa
dc.description.abstract	In the present article will review the issue of the surrogate motherhood in Colombia, since on the subject was evident a legal vacuum, because it does not have a specific regulation, thereby creating legal uncertainty in the nature, implementation, and effectiveness of this legal business. For this, an analysis should be made to the scientific background of the techniques of assisted human reproduction, as well as the review of the different postures legal from the comparative law and international courts, in the understanding that it is important to have a clear definition as to the relationship between surrogacy and the concept of affiliation and its different variables, and the positions of the Colombian High Courts with thematic relevance, based on the Constitutional Court Ruling T-968 of 2009 that provided a definition on surrogate motherhood and some legislative-driven bills.	spa
