| dc.description | La justicia ambiental naciĆ³ como un movimiento social originado en Estados Unidos, dejando al descubierto la precaria situaciĆ³n de comunidades afrodescendientes, poblaciĆ³n de origen latino, asiĆ”tico, nativos americanos que recibĆan la carga contaminante del Estado Federado, surge entonces el concepto de justicia ambiental demarcada por factores contaminantes tambiĆ©n relacionada con fenĆ³menos de pobreza y exclusiĆ³n. Colombia por diferentes factores, casi todos de Ćndole social, presenta una brecha de desigualdad muy amplia, donde estĆ” presente la degradaciĆ³n ambiental que impacta directamente a la poblaciĆ³n. AsĆ las cosas, este estudio se discriminarĆ” asĆ: El CapĆtulo I, se encargarĆ” de la presentaciĆ³n del concepto de justicia ambiental, en enfoque filosĆ³fico, ecolĆ³gico y social, se espera que de la lectura de este capĆtulo se pueda tener un conocimiento sobre cuĆ”l ha sido la influencia de la justicia ambiental en lo humano y no humano. Este concepto al ser aplicado en Colombia cuenta con diferentes mecanismos judiciales, como quiera que existan otras alternativas como los mecanismos de participaciĆ³n democrĆ”tica, asĆ las cosas el CapĆtulo II harĆ”n una descripciĆ³n de los mecanismos judiciales para la protecciĆ³n de la justicia ambiental y casos relevantes en el paĆs. Por Ćŗltimo el CapĆtulo III selecciona sentencias del H. Corte Constitucional, que para criterio de la autora son las que mejor exponen el avance jurisprudencial de la justicia ambiental en Colombia. | spa |
| dc.description.abstract | The Environmental Justice was born as a social fight originated in The United States, leaving exposed the precarious situation of communities where the most affected were the African descent, population of Latin America, Asian origin, native American aborigens who received the pollutant load of the Federated State, giving a few indicators in which the environmental justice not only is limited by pollutant factors, also it is intrinsically related to the phenomena of poverty and exclusion. Colombia for different factors, almost all of social nature, presents a very wide gap of inequality; where the environmental degradation is present and impacts directly on the population. On this way, this important study is discriminated this way: Chapter I, will take charge of the presentation of the concept of environmental justice, in a philosophical, ecological and a social key, it hopes that of the reading of this chapter it could have a wide knowledge about which has been the influence of the environmental justice between the human and not human factor. This concept of Environmental Justice must be applied; it is as well as this monograph has focused in the judicial mechanisms, and other alternatives as the mechanisms of democratic participation. Chapter II I will do a description of the judicial mechanisms for the protection of the environmental justice, relevant cases in the Country. Finally, Chapter III selects judgments of the H. Constitutional Court that under the criterion of the authoress are those who better expose the jurisprudential advance of the Environmental Justice in Colombia. | spa |
