Gestación subrogada y su implicación en el concepto jurídico de filiación materna

Abstract

The purpose of this research is to study surrogacy and its legal effects on filiation, for which analysis is carried out on assisted human reproduction techniques, going back to the beginnings of these. Subsequently, it is intended to analyze each technique in order to enter into legal matters, giving way to the study of some background of surrogacy, a legal approach to the situation in which surrogate motherhood is currently found regarding its legislative and jurisprudential development. to support the central thesis of the investigation, in which the factors that determine filiation in the framework of surrogacy are studied, to finally conclude by establishing the concepts that result from the investigation in support of doctrinal reflections on the subject. In the development of this research, the term surrogate pregnancy is used because the specific process is to gestate life, in the maternal womb, for which the receiving woman exercises her function of gestation but not maternity, therefore, for the purposes of the same will be used throughout the development the term surrogacy.
