En esta investigación se abordará el estudio de la gestación subrogada y sus
efectos jurídicos en la filiación, para lo cual se realiza un análisis sobre las técnicas de
reproducción humano asistida (TRHA), retrotrayéndose a los inicios de estas;
posteriormente se analiza la técnica de fecundación in vitro e inseminación artificial para
así poder entrar en materia jurídica, dando paso al estudio de algunos antecedentes
históricos y legales de la gestación subrogada, se realiza un acercamiento jurídico de la
situación en la que se encuentra la maternidad subrogada actualmente respecto a su
desarrollo legislativo y jurisprudencial para sustentar la tesis central de la investigación,
en la que se estudian los factores que determinan la filiación en el marco de la gestación
subrogada y por último establecer los conceptos que resultan de la investigación en apoyo
de reflexiones doctrinarias.
En el desarrollo de esta investigación se emplea el termino gestación subrogada
debido a que el proceso especifico es gestar la vida, por lo que la mujer receptora ejerce
su función de gestación mas no de maternidad, por lo tanto, para efectos de la misma se
utilizará en todo el desarrollo el termino gestación subrogada.
Abstract
The purpose of this research is to study surrogacy and its legal effects on filiation, for
which analysis is carried out on assisted human reproduction techniques, going back to the
beginnings of these. Subsequently, it is intended to analyze each technique in order to enter into
legal matters, giving way to the study of some background of surrogacy, a legal approach to the
situation in which surrogate motherhood is currently found regarding its legislative and
jurisprudential development. to support the central thesis of the investigation, in which the
factors that determine filiation in the framework of surrogacy are studied, to finally conclude by
establishing the concepts that result from the investigation in support of doctrinal reflections on
the subject. In the development of this research, the term surrogate pregnancy is used because the
specific process is to gestate life, in the maternal womb, for which the receiving woman
exercises her function of gestation but not maternity, therefore, for the purposes of the same will
be used throughout the development the term surrogacy.
