Resumen
El objetivo del documento es analizar la eclosión de la dignidad humana como basamento
jurídico-conceptual del Estado Social de Derecho en Colombia en diez (10) sentencias relevantes
de la Etapa de Transición o Inaugural de la Corte Constitucional colombiana (1992-1993). Para
dar respuesta a esa inquiria el documento se divide en cuatro capítulos: el primero, ubica los
antecedentes inmediatos que dieron origen a la Constitución Política de Colombia de 1991 y la
subsiguiente erección del Estado Social de Derecho; el segundo, aborda la creación y
funcionamiento de la Corte Constitucional Inaugural o de Transición (1992 y 1993),
identificando los magistrados que la conformaron, las tareas asignadas y la organización interna
del Tribunal; el tercer capítulo, contiene la selección y análisis de diez (10) de las sentencias más
relevantes de esa Corte inicial sui genereis, utilizando la metodología descriptiva-analítica
basada en la propuesta sostenida por Romero (2011) y los conceptos y prospectivas dadas por
López Medina (2015), de lo que resultó una síntesis detallada de como entendió esa Corporación
el concepto de marras y el papel que se le irrogó como valor, principio y derecho fundamental; el
capítulo final, consigna las conclusiones generales del escrito.
Abstract
This work aims to analyze the concept of human dignity underlie of rising of Colombian
Constitutional Law 1991, especially, the jurisprudence of Constitutional Court in its beginnings
(1992-1993). For that reason, the document is divided in four chapters: the first, identify the facts
before of the promulgation of Constitutional Law 1991, and the Social State of law as well;
second, study the beginning and working of the Constitutional Court, notably, its organization,
judges and tasks; third chapter, analyze the jurisprudence of the Constitutional Court throughout
10 significance sentences by following a structured method of ideation and comprehension from
two authors contributions Romero (2011), and López Medina (2015), How did the judge rule in
similar cases in the past? What were the arguments that he considered most convincing? In
consequence, the document explains how the concept of human dignity has been transforming in
a value, principle and right. The ends conclusions are in the final chapter of this investigation.
