| dc.description | La familia, como elemento fundamental que encarna los valoressociales, culturales y religiosos de una Nación, debe ser protegida.Compete al Estado reconocer sus nuevas formas de estructuracióny regularlas: familias ensambladas, reconstruidas, amalgamadas,mixtas, segundas nupcias, monoparental y homoparentales. Lafamilia nuclear se quedó corta, sus cambios son resultado de laequidad. La propuesta es abordar la relación entre el derecho yla familia, el impacto social que genera y prepararse para ellos.Objetivo de la investigación es analizar las sentencias creadoras dederecho de la Corte Constitucional Colombiana, que originaroncambios en la estructura jurídica de la familia en Colombia alextender los efectos de la sociedad patrimonial, derechos yobligaciones de las parejas heterosexuales que conforman unaunión marital de hecho, a las del mismo sexo.Método de investigación: Histórico Hermenéutico. Enfoque:Investigación cualitativa y analítica. Técnicas e instrumentos:Revisión documental de las sentencias de la Corte Constitucionalde Colombia creadoras de derecho. Fases: Identifiar, clasifiar,contratar y analizar las sentencias de la Corte Constitucional,generadoras de cambios en la estructura de la familia. Poblacióny muestra. Sentencias proferidas por la Corte Constitucionalentre los años de 1996 a 2012, que hacen tránsito a cosa juzgadaconstitucional.Las decisiones de la Corte Constitucional deben llevarnos areflxionar sobre las nuevas formas de estructuración familiar,desprovistos de perjuicios homofóbicos, y fortalecer la familiaheterosexual como santuario de vida. | es-ES |
| dc.description | The family, as a fundamental unit that embodies social, cultural, and religious values of any Country, should be protected. It is the State responsibility to recognize its new structuring methods and regulate them: assembled families, rebuilt, merged, mixed, second time marriage, single-parental, and homo-parental. The nucleus family fell short, its changes result from equity. The proposal is to approach the relationship between the law and the family, the social impact it causes, and prepare for them. The purpose of the research is to analyze right creating judgments issued by the Colombian Constitutional Court, which made changes in legal structure of the family in Colombia, by extending effects of the patrimonial society, rights and obligations of heterosexual couples forming any common law union, to those of the same sex. Research method: Historical hermeneutical. Approach: Qualitative and analytical research. Techniques and instruments: document review of judgments issued by the Colombian Constitutional Court creating law. Phases: To identify, classify, contract and analyze judgments issued by the Constitutional Court, producing changes of family structure. Population and sample: Judgments issued by the Constitutional Court between 1996 and 2012, considered as res judicata. Decisions made by the Constitutional Court should make us reflect on new ways of family organization, with no homophobic prejudices, and strengthen heterosexual family as a sanctuary of life. | en-US |
