dc.descriptionEl presente artículo es resultado de la investigación ejecutada por el Semillero de Políticas Públicas de la Facultad de Derecho de la Universidad La Gran Colombia Seccional Armenia. El objetivo es analizar la equidad en las garantías brindadas a las víctimas en la Ley 1448 de 2011 y a los victimarios en la Ley 975 de 2005 para el efectivo cumplimiento de sus derechos y obligaciones. En tal sentido se procederá a identificar en primer lugar, las causas que dieron origen a la aparición de grupos armados ilegales, su evolución a través de la historia y los intentos del Estado colombiano por combatir su actuar. En las conclusiones se evidenciará cómo las garantías brindadas a ambas partes del conflicto armado no reflejan equidad, por cuanto impone mayores cargas a las víctimas, quienes se ven sometidas al perdón de lo imperdonable, sumando a ello, las faltas de garantías para su reparación integral y el cumplimiento efectivo de sus derechos a la verdad, la justicia y la reparación. Por su parte los postulantes a la Ley de Justicia y Paz pueden acogerse fácilmente a los beneficios de la alternatividad de la pena llegando inclusive a facilitar la sustitución de la medida de aseguramiento por una medida no privativa de la libertad, hasta permitir el cumplimiento de la pena en el exterior, lejos del país que sufrió las consecuencias del conflicto armado interno. Actualmente  se augura con significativa esperanza un nuevo proceso de paz, el cual  impulsa el actual gobierno con los cabecillas de las FARC. En dicho contexto se está a la espera de la consecución de la paz y la reconciliación nacional.es-ES
dc.descriptionThe following article is presented as the result of the research done by the Public Policies research novices at the Law Faculty, Universidad la Gran Colombia Armenia headquarters†. The aim is to analyze equity and guarantees given to the victims by the 1448, 2011 Law and to the victimizers through the 975, 2005 Law towards the effective fulfillment of their Rights and Obligations. In this regard, we will proceed to identify in the first place, the causes that originated the emergence of illegal armed groups, its evolution through history and the attempts of Colombian the State to fight their actions. In the conclusions it will be evidenced how guarantees offered to both sides of the armed conflict don´t reflect equity though they impose greater burdens on the victims who are subjected to forgive the unforgivable, adding to it, the lack of guarantees to its integral reparation and the effective fulfillment of their right to the truth, justice, and reparation. In turn, the postulants to the Law of Justice and Peace can easily embrace the benefits of alternativity of the penalty even facilitating the substitution of the precautionary incarceration measurement for a non incarceration measurement to the point of allowing the fulfillment of the penalty abroad, far away from the country that suffered the consequences of the internal armed conflict. Nowadays, a new peace process forwarded by the actual government with FARC leaders is expected with great hope. In such a context peace and national reconciliation is expected from the peace iniciative.en-US
