In this way, to achieve the stated objective, a deductive methodology has been adopted, with exploratory tendencies, based on qualitative sources, based on the study of the Constitution, the law, jurisprudence and both national and international doctrine; with which, it can be determined that, there is a non-focused inconvenience in the sanctioning faculty of the Procurator, in relation to public servants elected by popular vote, but that such disagreement is presented in the type of sanctions that may be imposed on the disciplines subjects, since they limit the political rights recognized in international instruments that are so important in these instances.     Abstract

    En el desarrollo de este trabajo se podrá analizar la convencionalidad, o no de la facultad constitucional del Procurador General de la Nación, para desvincular a los funcionarios elegidos mediante voto popular, pues, en el derecho colombiano, desde el advenimiento de la Constitución Política de 1991, se ha iniciado un proceso de fortalecimiento del derecho constitucional interno con la inclusión de los postulados relacionados con el derecho internacional público, según el cual, los tratados internacionales que fundan los sistemas internacionales de derechos humanos, a través del procedimiento constitucional dispuesto para ello, se convierten en parte del bloque de constitucionalidad y por lo tanto, adquieren carácter obligatorio para los operadores jurídicos y administrativos internos. De tal forma, para lograr el objetivo planteado, se ha adoptado una metodología deductiva, con tendencias exploratorias, teniendo como fundamento fuentes de índole cualitativo, basadas en el estudio de la Constitución, la ley, la jurisprudencia y la doctrina tanto nacional como internacional; con lo cual, se puede determinar que, existe una inconvencionalidad no enfocada en la facultad sancionatoria del Procurador, en relación con los servidores públicos elegidos mediante voto popular, sino que tal discordancia se presenta en el tipo de sanciones que se pueden imponer a los sujetos disciplinables, ya que las mismas limitan los derechos políticos reconocidos en instrumentos internacionales que tanta importancia tienen en estas instancias.
