With the fall of global crude oil prices in mid-2014, the National Government headed by Juan Manuel Santos, who was starting his second presidential term, presented the National Development Plan 2014-2018 "All for new country, peace, education and equity ", in which as a measure to mitigate inflation and the economic deficit, he sought the appropriate way to encourage investment by both domestic and foreign companies, through the efficient issuance of mining titles. For this reason, the study of the alleged environmental damages caused by these mining activities became relevant. In the same way, the effects on the country's economy were determined. In order to establish certainty about the alleged confrontation between the right to a healthy environment and the right to economic freedom, the decisions of the Constitutional Court were analyzed as the highest organ of closure in the constitutional jurisdiction and the weighting test was applied. to determine if the breach of the principle of life was justified by the satisfaction of the principle of economic freedom.     Abstract

    La economía colombiana ha dependido en gran medida de la explotación y exportación de hidrocarburos, especialmente el petróleo y sus derivados. Con la caída de los precios del crudo a nivel global a mitad del año 2014, el Gobierno Nacional en cabeza de Juan Manuel Santos, quien iniciaba su segundo periodo presidencial, presentó el Plan Nacional de Desarrollo 2014-2018 “Todos por un nuevo país, paz, educación y equidad”, en el cual como medida de mitigación de la inflación y el déficit económico, buscó la forma adecuada de incentivar la inversión tanto de las empresas nacionales como las extranjeras, mediante la eficacia en la expedición de los títulos mineros. Por tal razón, se hizo pertinente el estudio de los presuntos daños ambientales ocasionados por estas actividades mineras. Del mismo modo, se determinaron los efectos en la economía del país. Con el fin de establecer certeza sobre el presunto enfrentamiento entre el derecho al medio ambiente sano y el derecho a la libertad económica, se analizaron los pronunciamientos de la Corte Constitucional, como máximo órgano de cierre en la jurisdicción constitucional y se aplicó el test de ponderación para determinar si se justificaba el incumplimiento del principio de la vida por la satisfacción del principio de la libertad económica.
