    Abstract

    En el presente trabajo se exponen los aspectos de orden jurídico de la responsabilidad extracontractual del Estado y sus agentes, de acuerdo con el Artículo 90 de la Constitución Política de Colombia de 1991, el Estado debe responder patrimonialmente por los daños antijurídicos que le sean imputables. Así mismo, este tiene a su cargo las medidas de restablecimiento de derechos de los menores de edad, las cuales debe aplicar en función de los principios del interés superior del menor, prevalencia de sus derechos y corresponsabilidad contenidos en los artículos 13 y 44 de la Constitución política de Colombia de 1991. Se examina la responsabilidad Estatal cuando se ocasiona un daño antijurídico a un niño o niña que se encuentra bajo el cuidado y protección del ICBF. para lo anterior, se limita el estudio al caso particular de la responsabilidad extracontractual del Estado, esto es, aquella en la que entre víctima y autor del daño no existe vínculo anterior alguno, o que si aún existe tal vínculo, el daño sufrido por la víctima no proviene de dicha relación anterior sino de otra circunstancia, por supuesto en sede administrativa atribuible al Estado o uno de sus agentes, en que el autor del daño, Estado o agente estatal como se verá, está obligado a indemnizar a la víctima de un perjuicio que no proviene de un vínculo jurídico previo entre las partes. Finalmente, dado el objeto sobre el cual se rige el presente escrito a partir de la referencia jurídica, se propone llamar la atención acerca de la falta de previsión que en materia de cuidado a la niñez desamparada en Colombia se ha venido gestando con los deficientes controles de los órganos competentes y la carente efectividad de las políticas públicas del Estado para hacer evidente el goce de los derechos de esta población, que requiere una especial protección.
