The information was obtained through surveys and interviews conducted with 20 Venezuelan citizens who develop such activity on the street already mentioned. It was emphasized, mainly, in the causes that originated the appearance of pedicabs as a means of ground transportation of passengers in the city of Bogotá D.C. and its current importance in the context of mobility and in the world of work. This activity has solved a serious problem related to the inefficiency of the urban passenger transport system in the Capital District, as well as straight, pedicabs´service, as a source of work for hundreds of citizens, not only from Colombia, but also from Venezuela, due to the current migratory crisis. On this last aspect, the Venezuelan migrant, specifically those who had entered illegally in the country, several topics were emphasized. First, the antecedents of the Venezuelan migration are enunciated to contextualize, not only from the global point of view, but also regional, the consequences of this phenomenon and its mainly impact in Colombia. Second, is to determine the reasons and conditions in which the currently Venezuelan migrant arrives in an irregular way to the country, and chooses to work in the pedicabs service. Third, the labor reality and issues that they face such as: The working day, Compensation, The existence of work contract elements, Social Security System inaccessibility, Non-recognition, Non-payment of social benefits, The configuration of duties and rights in the head of the subjects that are part of the employment relationship and the social impact that all of the above has generated.     Abstract

    En este estudio se determinaron y analizaron las condiciones laborales de los migrantes irregulares venezolanos que se desempeñan en la labor del bicitaxismo en la ciudad de Bogotá D.C.- Localidad Kennedy - Sector Dindalito, concretamente en la Calle 42 A Sur. La información se obtuvo por medio de encuestas y entrevistas realizadas a 20 ciudadanos venezolanos que desarrollan tal actividad sobre la vía vehicular ya mencionada. Se hizo hincapié, principalmente, en las causas que originaron la aparición de los bicitaxis como medio de transporte terrestre de pasajeros en la ciudad de Bogotá D.C. y su actual importancia no solo en el contexto de la movilidad sino también en el mundo del trabajo, dado que además de resolver una grave problemática referida a la inoperancia del sistema de transporte urbano de pasajeros en el Distrito Capital, también se ha logrado erigir, la actividad del bicitaxismo, como una fuente de trabajo para cientos de ciudadanos de origen no solo colombiano sino también, como consecuencia de la actual crisis migratoria, venezolano. Sobre este último aspecto, es decir, el migrante venezolano, y concretamente respecto del que ingresa ilegalmente al país, se enfatizaron varios temas. En un primer lugar, se enuncian los antecedentes de la migración venezolana, para luego contextualizar, no solo desde el punto de vista mundial sino también regional, las consecuencias de este fenómeno y su impacto principalmente en Colombia; para así determinar las razones y condiciones en que actualmente el migrante venezolano llegado de manera irregular al país opta por vincularse laboralmente al bicitaxismo; estableciéndose en verdad, cuál es la realidad laboral que afronta, abordando temas como lo son: la jornada laboral, la remuneración, la existencia de los elementos de un contrato de trabajo, el inacceso al Sistema General de Seguridad Social, el no reconocimiento e impago de prestaciones sociales, la configuración de deberes y derechos en cabeza de los sujetos que son parte de la relación laboral y el impacto social que todo lo anterior ha generado. Los datos analizados revelan el incumplimiento de las normas laborales para los migrantes venezolanos, además de dejar ver la existencia de políticas migratorias de regularización a las que el migrante venezolano no puede acceder precisamente por el modo en que se ve obligado a abandonar su país.
