    Abstract

    La presente investigación tiene por objeto objetivo, el señalar si es viable aplicar la prisión domiciliaria en Colombia para personal militar sindicado o condenado por delitos contra personas y bienes protegidos por el DIH, para ello, se desglosa, en un primer momento donde se describe los delitos contra personas y bienes protegidos por el Derecho Internacional Humanitario, de los que habla el título segundo de la ley 599 del año 2000, para que a cuenta seguida, se detalle las funciones de la pena, así como la de la figura de prisión domiciliaria en la legislación colombiana, para que finalmente, se revise si es viable aplicar la figura de la prisión domiciliaria para el personal militar sindicado o condenado por delitos contra personas y bienes protegidos por el Derecho Internacional Humanitario. Para lograr lo planteado, la investigación utiliza un enfoque cualitativo, y cuenta con un alcance exploratorio y deductivo. De manera que se evidencia, como la figura de la prisión domiciliaria para agentes del Estado que han cometido alguno de los delitos de los que habla el título segundo del código penal, ley 599 del año 2000, es viable, y que otra negativa de aplicar tal subrogado penal, resulta inconstitucional e inconvencional.
