    Abstract

    El estudio de la información acerca de la posible comisión de uno o varios de los crímenes competencia de la Corte Penal Internacional bajo el estándar de prueba denominado “base razonable para creer” se convierte en el criterio definitivo para las futuras decisiones de apertura de una investigación por parte de la Sala de Primera Instancia, teniendo como fundamento los exámenes preliminares realizados por la Fiscalía de la Corte. Esta monografía se propone contribuir al acercamiento de la CPI y su dinámica funcional al escenario del derecho penal internacional. Con ello se enriquecerán los debates existentes sobre la forma en que la Corte decide admitir una situación como una susceptible de su competencia.
