This method allows to analyze the legal problem thoroughly, demonstrating the judicial precedent regarding the topic in question in turn identifies the rules that must be taken into account to untie the conflict, for this, the Constitutional Court establishes the conflicts that generate conflict of jurisdiction; the supremacy of the principles, restrictions and limitations, the passive subject of society, the principle of lenity, using four criteria are; to greater conservation of their customs, greater autonomy; fundamental constitutional rights; the mandatory legal rules of public order; The customs of an indigenous community in rules dispositives. However, it is necessary to apply the four limits or evidence to establish competition either ordinary or special indigenous jurisdiction, which are: personal, territorial, institutional and objective thus allows dissolve conflicts of jurisdiction and in turn determine the competent without violating fundamental rights. To conclude, the line of decisions of the Constitutional Court is applicable and settled by the judicial system in actuality, also, the rules laid protect and guarantee the rights of active and passive subject, in the same way; unleashes conflicts generated by the collision Competition in the particular case and similar cases affecting indigenous justice.     Abstract

    Se realiza un análisis Teórico Descriptivo, a partir de una revisión teórica acerca de la jurisdicción especial indígena en el ordenamiento jurídico colombiano, el cual permite definir la jurisdicción ordinaria y especial indígena a través de cuatro marcos, los cuales son el Internacional, el Constitucional, el Legal y Reglamentario y jurisprudencial, este último, permite evidenciar los conflictos que generan Colisión de Competencia entre la Jurisdicción Ordinaria y Especial indígena en el caso de delitos en contra de niños, niñas y adolescentes, desarrollado a través de una línea jurisprudencial de la Corte Constitucional utilizando el método del derecho de los jueces del autor Diego López Medina. Este método permite analizar el problema jurídico a fondo, evidenciando el precedente judicial frente al tema en cuestión a su vez identifica las sub reglas que se deben tener en cuenta para desatar el conflicto, para ello la Corte Constitucional establece los conflictos que generan Colisión de Competencia; la supremacía de los principios, las restricciones y limitaciones, la afectación del sujeto pasivo de la sociedad mayoritaria, el principio de favorabilidad, por medio de cuatro criterios que son; a mayor conservación de sus usos y costumbres, mayor autonomía; los derechos fundamentales constitucionales; las normas legales imperativas de orden público; Los usos y costumbres de una comunidad indígena sobre normas dispositivas. No obstante, es necesario, aplicar los cuatro límites o elementos para establecer la competencia ya sea de la jurisdicción ordinaria o especial indígena, que son: el personal, territorial, institucional y objetivo de esta forma permite disolver los conflictos de competencia y a su vez determinar el competente sin vulnerar derechos fundamentales. A manera de conclusión, la línea jurisprudencial de la Corte Constitucional es aplicable y reiterada por el sistema judicial en la actualidad, así mismo, las sub reglas establecidas protegen y garantizan los derechos del sujeto activo y pasivo, del mismo modo; desata los conflictos que se generan por la colisión de Competencia en el caso en concreto y casos análogos que afecten la Justicia indígena.
