An example of this is the enactment of Law in Colombia 1774, of date January 6, 2016, which can be considered as a starting point to safeguard the integrity of our animal resources. But the law is not an isolated science, their knowledge areas and at some point be merged to achieve its goal of forcefully; so, as from criminology as a branch of criminal law is to strengthen the newly designed area of the animal law, so that we do not make the mistake that because we have the law, only think of the punishment before it is therefore essential “ius”, think about crime prevention, because note that the real purpose of criminal law is not repression, on the contrary, its raison d'etre must park in preventing the commission of punishable conduct and in the proper resocialization of those who may come to commit; taking the aquarium as a hobby, through which you can build a model of animal protection, to show that it is much more beneficial as a state criminal policy, to prevent rather than punish.     Abstract

    El derecho como ciencia que a diario evoluciona para complementar los retos que enfrenta el hombre y la sociedad, le ha permitido a los diversos movimientos que luchan incansablemente por los derechos de los animales, cimentar una rama de la ciencia jurídica, que ha llamado la atención de quienes dentro de los estados tienen la facultad de legislar, como potestad otorgada por el Constituyente Primario, a fin de garantizar la integridad de las criaturas que de uno u otro modo, a diario acompañan al hombre, como compañía, pasatiempo, herramienta de trabajo, en fin. Una muestra de ello, es la promulgación en Colombia de la Ley 1774, adiada 06 de enero de 2016, la cual se puede considerar como un punto de partida para salvaguardar la integridad de nuestro recurso animal. Pero el derecho no es una ciencia aislada, sus áreas y conocimientos en determinado momento deben fusionarse para poder lograr su objetivo de manera contundente; es así, como a partir de la criminología, como rama del derecho penal, se pretende fortalecer a la recién concebida área del derecho animal, para que no incurramos en el error de que porque tenemos la ley, únicamente pensemos en el castigo, antes de ello, resulta ius fundamental, pensar en la prevención del delito, pues téngase en cuenta que el verdadero objetivo del derecho penal no es la represión, por el contrario, su razón de ser debe estacionarse en la prevención de la comisión de las conductas punibles y en la adecuada resocialización de quienes las puedan llegar a cometer; teniendo a la acuariofilia como un pasatiempo, a través del cual se puede edificar un modelo de protección animal, para demostrar que resulta mucho más beneficioso como política criminal de un estado, prevenir antes que castigar.
