    Abstract

    Al observar en el campo jurídico del proceso penal Colombiano en especial del Código de Procedimiento Penal ley 600 de 2000 en comparación con la ley 906 de 2004, encontramos una figura jurídica que cambia el contexto tradicional de la constitución Política de 1991,enmarcado en un estado social de derecho con principios rectores y derechos fundamentales que están sujetos a el respeto de la dignidad humana, enfrentado a un sistema penal mixto inquisitivo y acusatorio que adquiere total firmeza como lo enuncia en el artículo 404 del C. de P. P., en donde se permite desconocer la seguridad jurídica de las providencias, su firmeza y ejecutoriedad, tomando en cuenta que la problemática se enmarca a que este articulo permite que luego de haberse debatido, se pueda Modificar la legalidad de la resolución de acusación, y esta se pueda en la etapa de juicio, a lo que se le llama Variación de la calificación jurídica provisional por parte de la parte acusadora el Fiscal o del propio juez de conocimiento, sin que esta pueda ser alegada por parte del acusado o afectado, situación que a la luz del derecho penal no Garantiza los principios constitucionales al debido proceso y principalmente a la defensa de dicho acusado
