Colombian law punishes and condemns a crime, apart from society who committed it. In addressing the murder of Don Chucho at the hands of her boyfriend, a 22 years while chatted in a commercial establishment called the Barracuda, imparting three shots as a firearm pistol, owned by the victim. We take as a starting point forensic psychology, specifically the theory of Post Traumatic Stress Disorder (PTSD), which allows us to argue and explain about the psychological, the generic and the origins of criminal behavior Wilmar through knowledge theorists of this discipline and interviews in the scene, which was achieved demonstrate the intention of Wilmar to take the firearm owned by his partner to defend and repel aggression was suffering. Finally, we conclude that to understand forensic psychology criminal action leads us to justify the non-criminal liability of Wilmar, forming a case of legitimate defense.     Abstract

    El homicidio es un delito grave, socialmente reprochable, cuyas consecuencias representan un serio perjuicio tanto para el criminal como para la víctima. La Ley Colombiana castiga y condena un crimen, separando de la sociedad a quien lo haya cometido. Al abordar el homicidio de Don Chcucho, a manos de su compañero sentimental, un joven de 22 años, mientras departían en un establecimiento de comercio llamado la Barracuda, propinándole tres disparos como un arma de fuego tipo pistola, de propiedad de la víctima. Tomamos como punto de partida la psicología forense, específicamente la teoría del Desorden de Estrés Post Traumático (DSPT), que nos permite argumentar y explicar sobre lo psicológico, lo genérico y sobre los orígenes de la conducta criminal de Wilmar, a través de los conocimientos teóricos de dicha disciplina y las entrevistas realizadas en el lugar de los hechos, se logra evidenciar cual fue la intensión de Wilmar al tomar el arma de fuego de propiedad de su pareja para defenderse y repeler la agresión que estaba sufriendo. Por último, se concluye, que la psicología forense al comprender la actuación criminal, nos lleva a justificar la no responsabilidad penal de Wilmar, configurando un acaso de Legítima Defensa.
