Thus, although euthanasia and medically assisted suicide are considered undesirable practices in society due to their nature, countries in the world such as the Netherlands, Belgium, Switzerland, Luxembourg, the United States and others have decriminalized them based on the human dignity and the free development of the personality of those who expressly request death in dignified conditions, because no person is compelled to live when he is in the midst of gruesome suffering due to a pathology that makes his life inhuman.     Abstract

    El constitucionalismo contemporáneo ha debido afrontar vertiginosas dilemáticas, todas con su respectiva importancia, sin embargo una de las que más ha causado revuelo en la sociedad y ha despertado especial interés en las doctrinas jurídico-filosóficas modernas es la eutanasia y el suicidio medicamente asistido, en tal sentido, la problemática en torno a las prácticas de muerte digna reviste una notable complejidad, pues trifulca directamente con el derecho a la vida, situación que desde el prisma de las nociones éticas-morales y religiosas es absolutamente inadmisible. Así las cosas, pese a que la eutanasia y el suicidio medicamente asistido se consideran prácticas indeseables en la sociedad debido a su naturaleza, países en el mundo como Holanda, Bélgica, Suiza, Luxemburgo, Estados Unidos y otros, las han despenalizado fundamentándose en la dignidad humana y el libre desarrollo de la personalidad de quien solicita expresamente morir en condiciones dignas, pues ninguna persona está compelida a vivir cuando se encuentra en medio de truculentos sufrimientos producto de una patología que hace inhumana su vida.
