Furthermore, an opposition between labor law and constitutional law principles that cause juridical insecurity for pensioners and pension’s administrator, are described in the current study. Therefore, it is evident that an analysis that allows the unification of criteria for interpretation and calculation of the base income estimation for pensions is needed. As a possible solution during the present study, the theory of Robert Alexy is used. This theory proposes equilibrium between conflicted rights that allows conciliation between rights preserving the rule of law (estado social de derecho).     Abstract

    La investigación adelantada permitió analizar el conflicto interpretativo presente entre la Corte Constitucional y el Consejo de Estado, respecto del cómo se debe liquidar el ingreso base de liquidación de las pensiones de los beneficiarios del régimen de transición de la ley 100 de 1993, para lo cual se analizó los criterios utilizados de las principales sentencias proferidas por estas altas cortes, adoptando una posición que permitió un acercamiento a los vacios normativos y posibles soluciones ante dicha controversia, además de evidenciar la oposición entre principios del derecho laboral y constitucional, que ocasionan inseguridad jurídica no solo para los pensionados que reclaman su derecho ante la administradora pensional, sino también para las entidades administradoras de pensiones que no tienen claridad de cual fallo se debe materializar. En ese orden de ideas se evidenció la necesidad de un análisis que contribuya a unificar la interpretación y establecer un solo razonamiento frente al cálculo del ingreso base de liquidación. Ahora bien, para generar un fallo que condense esas asimétricas posiciones esta investigación propone un posible modelo de interpretación, estructurado en las teorías de la ponderación de autores como Robert Alexy, que proponen un posible equilibrio entre los derechos enfrentados, para lo cual entonces se entrará a buscar una conciliación de forma armónica entre estos principios y/o derechos, en garantía del llamado estado social de derecho.
