Abstract

The purpose of this research is to analyze the results of the measures adopted by the current government of the city of Bogotá in the borough of La Candelaria, measuring its effectiveness against the protection of the vital minimum of street vendors, after carrying out studies, comparisons and measuring the effectiveness of these mechanisms concluded that they do not protect the right to the vital minimum of street vendors. According to the Constitutional Court in judgment T-581 of 2011, it was determined that the minimum minimum is to satisfy the minimum needs of the individual, evaluating the context of each specific case in order to determine the circumstances and make a qualitative assessment with the aim of satisfying the basic needs and finally the guarantee of the right to human dignity. It is this concept, then, the key to this investigation, since the measures implemented by the Mayor's Office of Bogotá should revolve around the protection of this fundamental right, rather than the preservation of public space as the right of the majority. thus, as in this research, the mechanisms adopted by the current district government through the Institute for the Social Economy are broken down one by one and we explain how the effectiveness of each mechanism is optimally measured, answering the question: Are the measures effective? that have been adopted by the district government to guarantee the vital minimum of street vendors in the town of La Candelaria? Achieving not only identify what are the measures implemented by the district government but also carrying out a thorough analysis, noting the failures of the measures and proposing a model for the implementation of an effective mechanism.
