According to the Constitutional Court in judgment T-581 of 2011, it was determined that the minimum minimum is to satisfy the minimum needs of the individual, evaluating the context of each specific case in order to determine the circumstances and make a qualitative assessment with the aim of satisfying the basic needs and finally the guarantee of the right to human dignity. It is this concept, then, the key to this investigation, since the measures implemented by the Mayor's Office of Bogotá should revolve around the protection of this fundamental right, rather than the preservation of public space as the right of the majority. thus, as in this research, the mechanisms adopted by the current district government through the Institute for the Social Economy are broken down one by one and we explain how the effectiveness of each mechanism is optimally measured, answering the question: Are the measures effective? that have been adopted by the district government to guarantee the vital minimum of street vendors in the town of La Candelaria? Achieving not only identify what are the measures implemented by the district government but also carrying out a thorough analysis, noting the failures of the measures and proposing a model for the implementation of an effective mechanism.     Abstract

    Esta investigación tiene como fin analizar los resultados de las medidas adoptadas por el actual gobierno distrital de Bogotá en la zona de La Candelaria frente a la protección del mínimo vital de los vendedores ambulantes. Para tal fin se revisaron las diferentes auditorías realizadas por la Contraloría de Bogotá y los informes del Instituto Para la Economía Social (IPES). El análisis se basó en el concepto de la Corte Constitucional, la cual en la sentencia T-581 del 2011 determina que el mínimo vital consiste en satisfacer las necesidades básicas del individuo, evaluando el contexto de cada caso en concreto para determinar las circunstancias y realizar una valoración cualitativa, buscando con esto garantizar el derecho a la dignidad humana. Bajo este concepto, la investigación parte de la idea de que las medidas implementadas por la Alcaldía Mayor de Bogotá deben girar en torno a la protección de este derecho fundamental, más que a la preservación del espacio público como derecho de la mayoría. Por tanto, esta investigación desglosa uno a uno los mecanismos adoptados a través del IPES, a la vez que se expone cómo se mide de manera óptima la eficacia de cada mecanismo, respondiendo a la pregunta: ¿Son eficaces las medidas que se han adoptado por el gobierno distrital para garantizar el mínimo vital de los vendedores ambulantes de la localidad de La Candelaria? El estudio permitió identificar y analizar las medidas implementadas por el gobierno distrital, advirtiendo sus fallas y proponiendo un modelo de implementación más eficaz.
