This arouses special interest from academic research, since it arise the need to establish if the mechanisms implemented in Colombian legislation are effective to counteract collusive acts as a restrictive competition practice. For this reason, the present research consolidates academic information that allows the identification of collusive acts as a restrictive practice of competition, the instability that they induce in the economy, and the effect that they provoke to consumers. It will also analyze the power of the Judges (lawyers) of the Colombian Republic to protect collective rights and interests and the role played by the Industry and Commerce Superintendence as an entity in charge of controlling, monitoring and punishing the companies that exercise restrictive practices of free competition. It should be recalled that collusive agreements or acts restrict to the entry of potential companies or competitors, infringe the right to free competition, unbalance the functioning of trade and directly affect the consumers’ economy.     Abstract

    En Colombia los actos colusorios constituyen una práctica restrictiva de la competencia, sin embargo, recientemente estos acuerdos entre empresas para controlar al mercado han quedado expuestos por parte de la Superintendencia de Industria y Comercio. Lo anterior despierta especial interés desde la investigación académica, puesto que surge la necesidad de establecer si son eficientes los mecanismos implementados en la legislación colombiana para contrarrestar los actos colusorios como práctica restrictiva de la competencia. Por ello la presente investigación, consolida información académica que permite identificar los actos colusorios como práctica restrictiva de la competencia, la inestabilidad que los mismos inducen en la economía, y la afectación que provocan en los consumidores. Asimismo, se analizará la facultad de los Jueces de la República de Colombia en su función de amparar los derechos e intereses colectivos, y el rol que desempeña la Superintendencia de Industria y Comercio como entidad encargada de controlar, vigilar y sancionar a las empresas que ejercen prácticas restrictivas de la libre competencia. Cabe recordar, que los acuerdos o actos colusorios restringen el ingreso de posibles empresas o competidores, atentan contra el Derecho a la libre competencia y desequilibran el funcionamiento del comercio afectando directamente la economía de los consumidores. En ese entendido, el papel de la Superintendencia de Industria y Comercio es protagonista en la persecución de carteles empresariales, por lo tanto, se analizará su desempeño en diferentes casos de acuerdos colusorios que involucran importantes gremios del mercado colombiano
