The problem posed questions the differences in expert development within the law of evidence in the two criminal systems. Thus, the general objective seeks to determine differences of a comparative type in the Colombian and United States expert evidence framework. A brief analysis is made of the reasons why a legal system can be the result of a legal transplant of systems that are relatively proven in their place of origin, as could be the case of Law 906 of 2004. It is concluded that the fundamental difference focuses on the technological distances of the two countries for the application of forensic evidence of probative importance in the first place. Secondly, the fact that the accusatory criminal system in Colombia does not concentrate its attention on research and, therefore, on expert expertise.     Abstract

    El artículo trata de la prueba pericial como objeto de estudio en el marco de las características del Sistema penal acusatorio de Colombia en contraste con su implementación, similitudes y diferencias en la justicia penal de Estados Unidos. El problema formulado se pregunta acerca de las diferencias en el desarrollo pericial dentro del derecho probatorio en los dos sistemas penales.Es así como, el objetivo general busca determinar diferencias de tipo comparado en el esquema probatorio pericial de Colombia y Estados Unidos. Metodológicamente se hace un breve análisis de investigación documental de las razones por las cuales un Sistema legal puede ser resultado de trasplante jurídico de sistemas relativamente probados en su lugar de origen, como podría ser el caso de la Ley 906 de 2004. A través de la búsqueda se concluye como resultados en primer lugar que la diferencia fundamental se centra en las distancias tecnólogicas de los dos países para la aplicación de pruebas periciales de importancia probatoria. En segundo término, el hecho de que el Sistema penal acusatorio en Colombia no concentra su atención en la investigación y, por tanto, en la experticia pericial. Tercero, en que la carga de la prueba recae en Estados Unidos en las partes acusatoria y defensora, como también lo es en Colombia, pero en la práctica los elementos culturales y de tipo económico inciden en la práctica real del uso de las pruebas periciales para una mejor aplicación de la justicia en ambos ordenamientos penales
