The research is descriptive with a deductive method in obtaining and analyzing information. The main results were obtained to the extent that there is a broad legal system developed from the international level (OIT, ONU, European Union), which were incorporated into the domestic legislation of Colombia and Spain, as the case may be, the challenges to attend The population in a situation of disability and social insertion in the social work life is still a task for each of the public agendas of the countries analyzed. The advanced public policies are diverse but the results are not enough, in the case of Colombia it is more complex due to the deficiencies in public policies in the workplace that still do not allow unemployment in the population in general, even less in people in situation of disability. In this aspect, the social, economic and political tensions that each country must solve must be strongly influenced, and this vulnerable population remains in the background in the priority of the public agenda.     Abstract

    El presente documento tiene como objetivo reflexionar sobre el marco legal y las políticas públicas creadas para incorporar al mercado laboral a las personas en condición de discapacidad, como una estrategia de inclusión social tanto en España como en Colombia. La investigación es de tipo descriptivo con un método deductivo en la obtención y análisis de la información. Los principales resultados que se obtuvieron es que si bien existe un amplio ordenamiento jurídico desarrollado desde el nivel internacional y (OIT, ONU, Unión Europea), las cuales se han incorporado en la legislación interna tanto de Colombia y España, según el caso, los retos para atender a la población en situación de discapacidad e incorporarla en la vida social laboral aún es un reto para cada una de las agendas públicas de los países analizados. Las políticas públicas adelantadas son diversas pero los resultados no son suficientes, para el caso de Colombia se presenta mayor complejidad por las deficientes políticas públicas en el ámbito laboral que aún no le permite disminuir el desempleo en la población en general, menos aún en las personas en situación de discapacidad. En este aspecto influyen fuertemente las tensiones sociales, económicas y políticas que internamente cada país debe solucionar y que cada día han dejado en segundo plano esta población vulnerable en la prioridad de la agenda pública.
