    Abstract

    El presente documento tiene como finalidad presentar algunas diferencias entre la aplicación penal en el sistema estadunidense y el colombiano, enfocándose en establecer la necesidad de la participación ciudadana en los asuntos de índole penal para la garantía de los derechos individuales de los sujetos procesados, así se llega a determinar que la participación ciudadana en estados unidos tiene gran similitud a la que históricamente Colombia tenia como un apoyo a las garantías del debido proceso, dándole oportunidades a los ciudadanos de ser juzgados por sus semejantes, pero que en teoría no funcionaria por las inconsistencias que se han presentado a lo largo de la historia colombiana que de por si han ocasionado que muchas figuras como esta no estén llamadas a prosperar en el ordenamiento, por otro lado no se puede dejar atrás que la aplicación judicial en el derecho anglosajón esta basado en las costumbres lo que hoy se llama el derecho consuetudinario razón mas que suficiente para que la aplicación de esta figura sea ajustada al derecho que se maneja allá.
