The question about the investigative faculties of the private accuser is something that increasingly takes importance in the Colombian legal field, since it is necessary to know to what limits the accuser is sealed in order to protect the legal rights of the indicted or imputed. For Montero Aroca granting legitimacy to all citizens, even those not offended, or harmed by crime, implies recognizing that the service of general interests is not only interested in the executive power, but that all citizens can participate, and also with different views of how this interest should be better served (Principios del proceso penal una explicación basada en la razón, 1997, pág. 57), is that true?, or the State in order to dissociate itself from a responsibility that could not solve, try to get rid of it by placing it in the head of third parties.     Abstract

    Con la congestión que se ha presentado en la etapa indagatoria de los procesos penales en el ámbito jurídico Colombiano, se ha evidenciado una vez más que lo que los teóricos y pensadores del derecho penal colombiano creen que es un problema de organización, es un problema económico y que al parecer el legislador en aras de “descongestionar los despachos fiscales” pretende librar de la carga de ejecutar los procesos penales al Estado, trasladándola o radicándola en cabeza de la víctima y de aquellas entidades administrativas que por sus características puedan ejercer control de la acción penal. La pregunta por las facultades investigativas del acusador particular es algo que cada vez más toma trascendencia en el ámbito jurídico colombiano, puesto que se hace necesario saber a qué limites se ve conminado el acusador en aras de la protección de los bienes jurídicos del indiciado o imputado. Para Montero Aroca el conceder legitimación a todos los ciudadanos, incluso a los no ofendidos, o perjudicados por el delito, implica reconocer que en el servicio de los intereses generales no está solamente interesado el poder ejecutivo, sino que pueden participar todos los ciudadanos, y además con visiones distintas de cómo se debe servir mejor dicho interés (Principios del proceso penal una explicación basada en la razón, 1997, pág. 57), ¿es eso cierto?, o el Estado en aras de desligarse de una responsabilidad que no pudo solventar, intenta deshacerse de ella radicándola en cabeza de terceros.
