| dc.description | Esta obra aborda las modificaciones realizadas por el legislador al artículo 317 del Código de Procedimiento Penal, Ley 906 de 2004, referente a las causales de libertad del imputado o sindicado. Frente al citado artículo, se analizara especialmente el numeral quinto donde se evidencia una injustificada prolongación de la privación a la libertad del acusado, por el retardo en el inicio del juicio oral, causal que no le es imputable al sindicado si no a la ineficiencia del estado. De lo anterior, surge la necesidad de estudiar los términos para la libertad, pues con las reformas del artículo ilustrado, se han generado confusiones en lo referente a cuando empiezan a contabilizar el vencimiento de los términos para obtener la libertad. | spa |
| dc.description.abstract | This work addresses the changes made by the legislature in Article 317 of the Criminal Procedure Code, Law 906 of 2004, concerning the grounds of freedom of the accused or accused. Facing the aforementioned article, analyze especially the fifth paragraph where an unreasonable prolongation of the deprivation of freedom of the accused, for the delay in starting the trial, cause that is not attributable to the accused if there is evidence to the inefficiency of state. From the above, the need to study the terms for freedom, as illustrated with Article reforms, gene-rado have confusions regarding when they start counting the expiration of the terms for freedom arises. | spa |
