    Abstract

    Esta investigación parte de la dificultad probatoria frente al acoso laboral a las personas portadora del VIH y que ejercen un contrato obra labor dentro de una empresa, por lo tanto se analiza la sentencia T -238 del 2008 en donde se refleja la falta de valoración del acervo probatorio por parte de la compañía y de las dos (2) primera instancias, dejando en descubierto por la Corte Constitucional que el acervo probatorio era suficientemente verídico para fallar el acoso laboral a favor del trabajador a través de los indicios que el trabajador impugno en primera instancia, alli también analizamos la ley 1010 del 2006 la cual regula el acoso laboral en donde verificamos que regula realmente la norma y si las partes que están obligadas a cumplir dicha norma lo cumplen por ellos realizamos un trabajo de campo al Ministerio de Protección Social en donde nos suministraron información del número de solicitudes de acoso laboral tramitadas y cuál es la finalidad de dicha entidad, por lo tanto ineficacia de la pruebas aportadas por el empleado ante un acoso laboral tiene que ver con la falta de valoración probatoria de las personas quien las analiza ya que no existe una imparcialidad, generando así una desigualdad probatoria y des favorabilidad por parte de la víctima.
