In that sense, it was necessary that the congress regulated in some way that factual situation that was growing. The first normative approach was before of Political constitution of 1991 for protecting families that were formed naturally. In that normative the marital union and its patrimonial regime between permanent partners was defined with 54 law of 1990 as the union made by a man and woman that without getting married make a permanent and singular community of life. That content is also applicable for couples of same sex. In 42th article of the constitution the family formed by natural or legal links has constitutional rank and the integral protection by the society and government, getting legitimate way to make a family. Although the law was incomplete because it was looking to define the marital union and patrimonial regime that is derivate from this kind of marital union and it didn’t consider and legislate specific and clearly the civil status as attribute of personality of permanent partners that is derivate of marital union; that’s why has been necessary through jurisprudence matching the marital union with the marriage link. Nowadays the Supreme Court has a jurisprudential thesis that recognize that the marital union is a real civil status arguing that there is some rules that make equal treatment for marital union and marriage, therefore it is creator of a civil status that permit include it in the first article of 1260 decree of 1970 through which is issued the civil register statute of people. With all these deficiencies on the law, it is necessary improvements in the regulation making clear every aspect of the marital unions.     Abstract

    Anteriormente, las uniones entre personas sin que existiera el vínculo a través de la institución del matrimonio, eran tenidas en cuenta como simples concubinatos, situación que fue evolucionado debido al crecimiento continuo de uniones sin casarse pero con la finalidad de formar familia y de mantener una continuidad de vida permanente y singular, en tal sentido que se hizo necesario que el legislador regulara de alguna manera esta situación fáctica en crecimiento. El primer acercamiento normativo y con el ánimo de proteger a las familias constituidas por vínculos naturales, se dio antes de la Constitución Política de 1991 en la cual las uniones maritales de hecho y su régimen patrimonial entre compañeros permanentes se definió con la Ley 54 de 1990 como la formada entre un hombre y una mujer, que sin estar casados, hacen una comunidad de vida permanente y singular. Este contenido se hace también es extensivo a las parejas del mismo sexo. Con la Constitución Política en el artículo 42 se elevó a rango constitucional a la familia constituida por vínculos naturales o jurídicos y la protección integral por parte el estado y la sociedad, en tal sentido, que se convirtió en una forma legítima de hacer familia. Si bien es cierto, se reguló de forma incompleta toda vez que la Ley en mención se encaminó a la definición de las uniones maritales de hecho y al régimen patrimonial que se deriva de este tipo de uniones y no consideró ni legisló de forma clara y específica el estado civil como atributo de la personalidad de los compañeros permanentes que se deriva de la unión marital, por ello ha sido necesario a través de la jurisprudencia que se busca equiparar en este sentido la unión marital de hecho con el vínculo del matrimonio, de tal suerte que actualmente hay una marcada tesis jurisprudencial de los honorables magistrados de la Corte Suprema de Justicia de reconocer que la unión marital de hecho constituye un verdadero estado civil, fundando su argumentación en que existen normas que le dan tratamiento equiparable al matrimonio por lo tanto es creadora de un estado civil que permite incluirla en la definición del artículo 1 del Decreto 1260 de 1970 a través del cual se expide el estatuto del registro civil de las personas. Con estas deficiencias en el ordenamiento jurídico existente, se hace necesario que se reglamente de forma clara todos los aspectos derivados de las uniones maritales de hecho.
