The practice of extrajudicial conciliation in equity is performed by people without adequate training or qualifications in law, which is contrary to the requirements under Article 5 of Law 640 of 2001. Considering that in the same law are items that can be used independently to accept or reject the requirement of procedural by conciliation in equity figure, this is not limiting for this mechanism is being used widely for compliance with the procedural requirement, a factor that makes it attractive "be free and easily accessible." The mechanism of conciliation in equity fulfills the purpose of Judicial congestion in minor conflicts, but this mechanism is not ideal to meet the procedural requirement, this exercise should be done by trained people through extrajudicial conciliation in law, such so that the institution of conciliation fulfill its objective.     Abstract

    La conciliación extrajudicial en equidad es uno de los mecanismos alternativos de resolución de conflictos, puede ser ejercido por particulares de manera transitoria con amparo en el artículo 116 de la constitución política de Colombia, dicho mecanismo no exige para el conciliador en equidad que cumpla con los requisitos del artículo 5 de la ley 640 de 2001, que entre otros aspectos exige para el conciliador en derecho que “deberá ser abogado titulado”. La conciliación extrajudicial adicionalmente cumple con el fin del requisito de procedibilidad El artículo 35 de la Ley 640 modificado por el artículo 52 de la Ley 1395 de 2010, textualmente permite que mediante la conciliación extrajudicial en equidad se cumpla el requisito de procedibilidad, dándole el mismo tenor que la conciliación extrajudicial en derecho. El ejercicio de la conciliación extrajudicial en equidad es realizado por personas sin la capacitación ni formación adecuadas en derecho, lo que resulta contrario a lo exigido en el artículo 5 de la Ley 640 de 2001. Teniendo en cuenta que en la misma ley se encuentran artículos que pueden ser utilizados de manera independiente para aceptar o rechazar el cumplimiento del requisito de procedibilidad mediante la figura de conciliación en equidad, esto no es limitante para este mecanismo se esté utilizando de manera generalizada para el cumplimiento del requisito de procedibilidad, con un factor que lo vuelve atractivo “ser gratuito y de fácil acceso”. El mecanismo de conciliación extrajudicial en equidad cumple con el propósito de descongestión Judicial en conflictos menores, pero este mecanismo no es idóneo para cumplir con el requisito de procedibilidad, este ejercicio debe realizarse por personas capacitadas a través de la conciliación extrajudicial en derecho, de tal forma que la institución de la conciliación cumpla con su objetivo.
