Reducción de riesgos por corrupción en Contratación Estatal

Abstract

The following document includes an analysis of the relationship between public procurement and corruption, as recurrent variables in the administration of public resources and that affect the administrative management of State entities. This phenomenon constitutes an important problem, which has achieved greater prominence in recent years, because it is more identified and recurrent in the public sphere, demanding the formulation of mechanisms and measures aimed at its control and that now mark the path towards the anticipation of risk, to reduce its scope and impact. In this analysis, different mechanisms were described to control and reduce corruption in public procurement but that have not produced the expected results. Among them is the generation of new regulatory and sanctioning laws, which have been useless to reduce or solve the problem, partly due to situations such as their lack of rigor in the application or because they are very flexible in face of the seriousness of the behaviors of the officials, which shows precarious results in front of the expectations that are formulated with these mechanisms. For its elaboration different bibliographical sources were consulted, in search of antecedents that allow to conceptualize to the public contracting, the corruption and to establish observations in which the points of relation between them are identified, finding for example that, the corruption in the public contracting originates from factors such as the lack of more precise regulation and effective control, especially in an environment where there is a high flow of resources that can be diverted using different paths, in addition, that this is a recurring phenomenon in the various countries of the world, It is not unique to Colombia.
