Resumen
El siguiente documento, incluye un análisis sobre la relación existente entre la contratación pública y la corrupción, como variables que afectan la gestión administrativa de las entidades del Estado. Esto se constituye en una problemática que ha alcanzado mayor protagonismo en los últimos años, debido a que es más identificada y recurrente en el ámbito público, demandando la formulación de mecanismos y medidas orientadas a su control y que ahora marcan el camino hacia la anticipación del riesgo, para reducir su alcance e impacto. En este análisis se describieron diferentes mecanismos para controlar y reducir la corrupción en contratación, como la generación de nuevas leyes regulatorias y sancionatorias, las cuales han resultado inútiles para reducir o solucionar el problema, en parte por la falta de rigurosidad en su aplicación o porque son muy flexibles frente a la gravedad de las conductas de los funcionarios. Se consultaron diferentes fuentes bibliográficas, observando puntos de relación entre las variables estudiadas, encontrando que la corrupción en la contratación pública se origina por diferentes factores como la falta de normatividad más precisa y de control efectivo, especialmente en un entorno en donde hay una alta circulación de recursos que pueden ser desviados utilizando diversos caminos.
Abstract
The following document includes an analysis of the relationship between public procurement and corruption, as recurrent variables in the administration of public resources and that affect the administrative management of State entities. This phenomenon constitutes an important problem, which has achieved greater prominence in recent years, because it is more identified and recurrent in the public sphere, demanding the formulation of mechanisms and measures aimed at its control and that now mark the path towards the anticipation of risk, to reduce its scope and impact.
In this analysis, different mechanisms were described to control and reduce corruption in public procurement but that have not produced the expected results. Among them is the generation of new regulatory and sanctioning laws, which have been useless to reduce or solve the problem, partly due to situations such as their lack of rigor in the application or because they are very flexible in face of the seriousness of the behaviors of the officials, which shows precarious results in front of the expectations that are formulated with these mechanisms. For its elaboration different bibliographical sources were consulted, in search of antecedents that allow to conceptualize to the public contracting, the corruption and to establish observations in which the points of relation between them are identified, finding for example that, the corruption in the public contracting originates from factors such as the lack of more precise regulation and effective control, especially in an environment where there is a high flow of resources that can be diverted using different paths, in addition, that this is a recurring phenomenon in the various countries of the world, It is not unique to Colombia.
